PURPOSE: A magneto-resistance element, a magnetic head, and a magnetic recording/reproducing device are provided to supply a magnetic recording/reproducing device where a magnetic head for using a magneto-resistance element is mounted to realize a high-density recording property without a vortex domain and a spin transmission torque phenomenon. CONSTITUTION: A lower layer(2) is formed on a substrate(1), and a non-magnetic conductive layer(3) is formed on the lower layer(2). The first and second magnetic layers(11,12) are formed on the non-magnetic conductive layer(3). The first and second magnetic layers(11,12) are separated from each other, but contacted with the non-magnetic conductive layer(3). A magnetic direction of the first and second magnetic layers(11,12) is substantially fixed. The non-magnetic conductive layer(3) functions as a path for flowing a spin-polarized electron into the second magnetic layer(12) from the first magnetic layer(11). Electrodes(21,22) are provided on top of the first and second magnetic layers(11,12), respectively.
