PURPOSE: A device and a method for inserting user information into a photographed image of a camera phone are provided to insert user information into a photographed image by using a watermarking technology, and to extract a watermark from the image to extract the inserted user information, thereby preventing a camera phone user from illegally photographing or distributing photographed images. CONSTITUTION: When a call is requested from a calling terminal(S31), a gateway confirms telephone numbers of the calling terminal and a called terminal(S32), and connects a speech path between the two terminals(S33). If an image file is transmitted from the calling terminal(S34), the gateway confirms whether a watermark is previously inserted into the transmitted image file(S35). If not, the gateway inserts a watermark including telephone number information on the calling terminal into the image file(S36), and sends the image file inserted with the watermark to the called terminal(S37). If a call termination is requested(S39), the gateway releases the speech path.
