PROBLEM TO BE SOLVED: To provide improved constitution in the embedding processing and detecting processing of an electronic watermark to data which can be given processing such as picture format conversion. SOLUTION: In the case of embedding the electronic watermark to the data which can be given format conversion such as an HD picture, a SD picture, etc., the lowest common multiple picture size of picture sizes before/after format conversion is set, the value of the electronic watermark in the picture after conversion in the lowest common multiple picture is set, the value of the electronic watermark in the picture before conversion is set based on the value, and this is embedded into the picture. Though conversion processing of the picture having the electronic watermark embedded therein is performed, a precise electronic watermark is detected surely from the picture after conversion.
