A device for avoiding and solving a conflict in reserving channel time in a distributed WPAN(Wireless Personal Area Network), a reservation system having the same, and a method thereof are provided to avoid a reservation conflict, which can be occur under data slot reservation negotiation, previously by using an extended DRP(Distributed Reservation Protocol) availability information element. A device(100) for avoiding and solving a conflict in reserving channel time in a distributed WPAN comprises an interface part(110), a DRP information element generating part(120), a DRP availability information element generating part(130), an extended DRP availability information element generating part(140), and a control part(150). The interface part(110) relays communication with another device in the distributed WPAN. The DRP information element generating part(120) creates a DRP information element. The DRP availability information element generating part(130) combines DRP information elements, transmitted through the interface part(110) from adjacent devices, and creates a DRP availability information element. The extended DRP availability information element generating part(140) creates an extended DRP availability information element for informing whether data slot reservation is possible in an extended area. The control part(150) receives an extended DRP availability information element, broadcasted through the interface part(110) from an adjacent device, and determines a data slot to reserve.
