The data communication method of a mobile communication terminal and the mobile terminal are provided to select an access type suitable for a network state in an RLC(Radio Link Control) acknowledge mode, thereby increasing the success rate of a packet access procedure. A counter variable of an access type counter for selecting an access type is initialized(S300-S302). If the counter value is larger than a reference value, the packet access procedure of a 2-phase access type is performed, and the counter variable is calculated on the basis of a received message(S303-S307). If the calculated counter variable is equal to or smaller than the reference value, a 1-phase access type is selected, and the packet transfer mode of a 1-phase access procedure is carried out(S308-S310).
