PROBLEM TO BE SOLVED: To provide an optical element which includes a birefringence functional layer composed of a polymerizable liquid crystal material, does not disturb alignment and performance of the birefringence functional layer in a succeeding additional post process after forming the birefringence functional layer on a substrate directly and indirectly and, as the result, can exhibit a high-quality retardation control function, to provide a liquid crystal display device provided with the optical element, to provide a method of evaluating the birefringence functional layer not adversely affected by the post process, and to provide a manufacturing method of the optical element.;SOLUTION: The optical element comprises at least: a light-transmitting substrate; and the birefringence functional layer made of a polymerizable liquid crystal material, wherein the birefringence functional layer is constituted by aligning and fixing a polymerizable liquid crystal monomer having a polymerizable group at least at one terminal directly or indirectly onto the substrate and a degree of reduction of residual double bonds in the birefringence functional layer before and after heat treatment at 250C for 1 hr is less than 0.25.;COPYRIGHT: (C)2008,JPO&INPIT
