An apparatus and a method for detecting a vehicle in the day and night according to luminous state are provided to detect the vehicle in various environments including day and night, thereby contriving development of a related system. A method for detecting a vehicle in the day and night according to luminous state includes the steps of: acquiring an image of the vehicle using a camera(200); calculating a luminous index from the image(205); judging the luminous state corresponding to the calculated luminous index(210); judging day, night, and middle states using the calculated luminous index(215); and detecting the vehicle from the image corresponding to the previous state in case of the middle state(220).
