PPROBLEM TO BE SOLVED: To physically limit illegal copy of digital contents of music, image and program or the like, and to effectively limit utilization of copied contents. PSOLUTION: The digital copy prevention processing apparatus is provided with: a guard data storage unit 25 storing guard data which are appended to digital data of sound or image and of which the presence is sensed only during playback after digital data are compressed; a data analysis unit 22 in which a position of a digital value having a predetermined increase rate and a predetermined magnitude in the digital data is specified as a peak position, a flag is set to a digital value located away from the peak position for a predetermined number and a plurality of digital values spread over the predetermined number from the digital value to which the relevant flag is set are set as a data pattern; and a guard data append processing unit 23 for modifying the digital data by appending the guard data at a position where the data pattern is disposed.
