PROBLEM TO BE SOLVED: To provide a Ce activated rare earth aluminate type phosphor which shows a yellowish emission improved in emission luminance and luminescent color and a luminous element using the phosphor.;SOLUTION: The Ce activated rare earth aluminate type phosphor has a composition shown by (Ln1-x-y-zCexTbyMz)2O3-n(Al1-p-qGapBq)2O3-mX and containing carbon (C). (wherein Ln represents one of rare earth elements consisting of Y, La, Gd and Lu; M represents one of elements comprising Eu, Sm, Tm, Pr, Mn and Cr; X represents a halogen element; n, m, x, y, z, p and q are respectively 1.8≤n≤1.5, 0≤m≤5×10-2, 5×10-3≤x≤2×10-1, 0≤y≤0.6, 0≤z≤0.1, 0≤p≤0.6 and 0≤q≤0.05).
