PROBLEM TO BE SOLVED: To provide a rail flaw detection apparatus capable of accurately measuring the depth of a flaw in a lower oblique direction and reducing the number of components, having a simple structure and capable of simplifying rail flaw detection work and shortening flaw detection time, and to provide a rail flaw detection method capable of accurately measuring the depth of a flaw in a lower oblique direction, simplifying rail flaw detection work and shortening flaw detection time.SOLUTION: A phased array probe 50T for transmission configured by arraying a plurality of first ultrasonic vibrators and a phased array probe 50R for reception configured by arraying a plurality of second ultrasonic vibrators are arranged so as to put a belly part 100d of a rail 100 therebetween and either of the probes 50T and 50R is arranged while abutting on a lower surface of an upper neck part 100c of the rail forming a curved surface 101 or a head part 100a of the rail. An ultrasonic wave is applied from the phased array probe 50T for transmission to a wheel tread 100b of the rail 100, an echo of the ultrasonic wave is received by the phased array probe 50R for reception and a flaw of the rail 100 is detected from the echo.SELECTED DRAWING: Figure 2
