According to various aspects of the present disclosure, an apparatus may transmit a first data resource element for a first UE on a base layer. The first UE is not configured for NOMA communication. The device may also transmit data for the second UE on an enhancement layer. The second UE is configured for NOMA communication. Additionally, an enhancement layer is overlaid on the base layer. The reference signal may comprise a cell specific reference signal. The apparatus may be further configured to receive a traffic power ratio for a second UE to which the second UE is to be subjected if the second UE is a base layer UE in NOMA communication.
