摘要

This research discusses about the application of the principle of justice PT. Asuransi Wahana Tata’s motor vehicle insurance policy and consumer protection. With the application of the principle of justice, it is expected that the parties can obtain the proper rights and responsibilities. In this research, normative legal research method which is legal research is conducted to explore library materials and positive legal norms by means of systematizing the laws associated with the object of research studies is PT. AsuransiWahana Tata motor vehicle insurance policy. It is concluded that PT. AsuransiWahana Tata motor vehicle insurance policy has not implement the principle of justice. Injustice occurs in the process of making agreement that cannot be negotiated and included in the application of a standard clause in an insurance policy which harm consumers. There are listed articles making the insured does not get the right to receive cash compensation for uncertain events that happened to them and caused loss to the insured. Normative juridical insurance consumer protection of PT. AsuransiWahana Tata has been regulated in Law No. 8 of 1999 about Consumer Protection, but has not been fully materialized. It needs to be reviewed and reorganizedPT. AsuransiWahana Tata motor vehicle insurance policy that meets the principles of justice and regard for the rights of the whole consumers. Companies should provide the information clearly, correctly and honest about the benefits and guarantees given by motor vehicle insurance. It is also necessary the oversight of the government to provide protection to theconsumers in insurance services,especially on supervising of using standart clause in insurance policy.
