The Federal Judicial Center prepared this report at the request of the Advisory211u001eCommittee on Civil Rules to provide an empirical context for the Committee's 211u001econsideration of the need for change in the discovery rules. Based on responses 211u001efrom nearly 1,200 attorneys nationwide, the report provides a timely assessment 211u001eof the effects of the 1993 amendments to the discovery rules, including initial 211u001edisclosure. It also provides information about discovery costs in the context of 211u001ethe overall costs of civil litigation, about problems experienced by attorneys in 211u001ea sample of recently terminated cases, and about attorneys' preferences for rule 211u001erevisions and other changes that might improve discovery.
