In this iteration of the case, the court is dealing with a series of discovery disputes and the motion of the United States to recover certain expenses and attorney's fees regarding those disputes. Under RCFC 37, such expenses and fees may be awarded where discovery motions, be they motions to compel or protective orders, are denied. Notwithstanding the plaintiffs claim that it acted in good faith, the court finds that its actions in relitigating certain issues that had already been decided by the court justify the imposition of expenses and fees.
