Leading sunscreen brands are already battling suits alleging SPF deception on the basis of conflicting test results, but developments in litigation against The Honest Company suggest that consumers may be able to claim fraud when sunscreen fails to prevent a sunburn. The Ho nes t C o m p any is preparing to settle a putative class action in California's Central District contending that its sunscreen efficacy claims are bogus because users suffered sunburns. The case, Shane Michael, et al., v. Honest Company, Inc., focuses more prominently on the firm's "natural" claims on hand soap, diapers and home cleaning products, claiming that "Honest isn't."
