Ohio Appellate Court Determines Vertical Limits of Adverse Possessor's Rights to Oil and Gas In a case of first impression, the Ohio Seventh District Court of Appeals held in Tomechko v. Garrett, 2021-Ohio-1377 (7th Dist), that a surface owner who adversely possessed shallow oil and gas pursuant to an oil and gas lease with no depth restriction adversely possessed all depths.
