A group of landowners has asked the US Supreme Court to weigh in on the legal pathway open to those opposing use of eminent domain for interstate natural gas pipeline projects approved by the Federal Energy Regulatory Commission. At issue is a June 21 decision by the US Court of Appeals for the District of Columbia Circuit that set aside a challenge brought by landowners opposing the use of eminent domain to acquire property to make way for the 304-mile, 2 Bcf/d Mountain Valley Pipeline (Cletus Bohon v. FERC, 20-5203).
