Tri-State Generation and Transmission Association is facing allegationsthat its board of directors deceived United Power, the electric powerco-op’s largest member, to preempt a pair of complaints currentlypending before Colorado regulators.In a May 4 lawsuit, United Power claimed it was unaware of a“secret plan” by Tri-State’s board of directors - allegedly codenamed“Blue Sky II” — to explore ways to become subject to federal regulationwhen United Power lobbied for an April 2019 bylaw that cleared theway for new nonutility membership in Tri-State.
