Indian court quashes FMC’s chlorantraniliprole suit appeal against Natco

The Indian Delhi High Court has dismissed FMC’s appeal of an unfavourable judgement by another judge in the same Court on a patent infringement lawsuit by the company involving its insecticide, chlorantraniliprole, against Hyderabad-based Indian company Natco Pharma. A two-judge division bench upheld the Court’s September ruling that lifted an interim injunction against the defendant, backing the observation that Natco’s use of the reagent, thionyl chloride, cannot be considered an equivalent to FMC’s application of sulfonyl chloride, and hence cannot be deemed a violation of the latter’s Indian patent.
