The term "Person2Person Payment" is commonly used to describe electronic funds transfers from one consumer to another, and the simple fact that the transfer actually takes place between banks is not enough to warrant the issuance of a mark for the phrase, the Trademark Trial and Appeal Board held Sept. 27. (In re ING Direct Bancorp, T.T.A.B., No. 77694743, 9/27/11) The board determined that the term is generic and is understood by the public to concern payments from one individual to another. Accordingly, the court upheld the trademark examining attorney's refusal to register the mark.
