In its October 2019 "Market Snapshot" report, the Consumer Financial Protection Bureau (CFPB) examines background screening reports that are subject to the Fair Credit Reporting Act (FCRA). Focusing on those reports that include criminal history information and are used for employment purposes, the Bureau sketches the background screening industry, how reports are generated, and how employers use the reports. Further, the CFPB’s Market Snapshot report discusses the challenges associated with accurate reporting and dispute resolution, and notes recent legal developments as well as technological changes taking place in the market.
