The EEOC will need to adjust its current EEO-1 Report deadline for employers to collect retroactively their 2018 "Component 2" pay data information and submit it to the agency by September 30, 2019, according to an April 3 pleading submitted by the Office of Management and Budget in the ongoing court case over the OMB’s nowvacated stay of the pay data requirement. Pay data component reinstated. On March 4, 2019, in National Women's Law Center v. Office of Management and Budget, the federal district court in D.C. declared that the OMB’s stay of the EEOC’s pay data collection was "illegal." The court found that the OMB’s deficiencies were substantial and that it was unlikely that the government could justify its decision on remand.
