Court, PTO at Odds Over Commodities Trading Patent Eligibility

Patents on a graphical user interface for electronic commodities trading continued to show a divide between an administrative tribunal at the Patent and Trademark Office and a federal appeals court. The Patent Trial and Appeal Board, in a rare 2-1 split decision, found Aug. 7 that Trading Technologies International Inc.'s U.S. Patent No. 7,813,996 claimed an abstract idea ineligible for patenting (IBG LLC v. Trading Techs. Int'l, Inc., P.T.A.B., CBM2016-00031, 8/7/17).
