Proposed penalties of about $21,000 for six citations were reduced to $12,000 by ALJ Michael Zielinksi against Tri-County Coal for violations at its Crown III Mine, an underground coal mine in Illinois. On Aug. 5, 2010, MSHA issued a citation for §75.1725(a), which requires mobile and stationary equipment to be maintained in a safe operating condition. Inspectors found a Simmons-Rand battery powered ram car with weak brakes and ordered it taken out of service. The mine had been cited 27 times in the past two years for the same citation. It was alleged to be S&S, with moderate negligence and a special assessment of $3,700.
