French, Swiss cheese groups rebuffed as US court rules ‘gruyere' a generic term not a GI

A bid to overturn the US Patent and Trademark Office's (USPTO) Trademark Trial and Appeal Board's (TTAB) decision that ‘gruyere' is a generic term referring to a style of cheese and is not trademarkable was rejected by US District Court Judge T.S. Ellis, setting back efforts by French and Swiss cheese groups to restrict use of the name in the US marketplace.
