A federal judge has turned down a request for an injunction to stop Kinder Morgan from starting work on its planned Permian Highway Pipeline,but the company only has a few days to proceed.US District Judge Robert Pitman said Kinder Morgan can begin work,but it will not be allowed to clear any vegetation from Mar.1-Jul.31 in habitat areas for the golden-cheeked warbler-a bird on the endangered species list.The temporary restraining order was only part of an endangered species lawsuit filed earlier this month against Kinder Morgan by the cities of Austin and San Marcos,Hays and Travis Counties,the Barton Springs Edwards Aquifer Conservation District and various landowners(NGW Jan.27'20).
