The Latest: The German federal commissioner for data protection and freedom of information has warned against the federal police force using Amazon Web Services (AWS) to upload data from their recording devices. Implications: This is the first concrete example of a European authority warning against the recently-passed CLOUD Act, under which US tech companies must comply with US authorities’ request for information, even if the data is stored abroad. While the argument is very similar to the one made by the US with regards to Huawei Technologies and the Chinese state, it has other implications. Many countries have looked at data sovereignty or localisation rules to gain greater control of domestic data, but the CLOUD Act bypasses these decisions. This is even more relevant as the main leaders in the cloud market - AWS, Microsoft Azure, and Google Cloud - are all American companies. This is why we believe the current techlash will spill over to the enterprise market in Europe, as different authorities look to ensure they retain jurisdiction in key areas, such as security.
