Florida Cites EPA Push For State Nutrient Limits To Reverse Novel Criteria

The Florida Department of Environmental Protection (FDEP) is asking EPA to withdraw its 2009 finding that requires the state to follow EPA's controversial numeric nutrient criteria, saying the agency's recent memo pushing states to develop their own nutrient control approaches suggests FDEP would be better poised to develop the criteria than EPA. In their April 22 petition to EPA, FDEP argues that, according to a March 16 memo from acting Assistant Administrator for the Office of Water Nancy Stoner that lays out a framework for states to develop their own numeric water quality measures, Florida is well suited to develop its own standards.
