The head of the Department of Justice's (DOJ) Civil Rights Division says the department is "focused" on using Title VI of the Civil Rights Act, which bars discrimination by recipients of federal funds, to pursue claims against polluters in environmental justice communities, a shift driven by a recent successful claim by the Transportation Department (DOT). At the Dec. 15 White House Environmental Justice Forum, Assistant Attorney General Thomas E. Perez called Title VI "a sleeping giant" that could be used in helping those minority and poor communities that are disproportionally impacted by contamination bring suit against polluters. "We are very focused on using Title VI and waking up that sleeping giant," Perez said.
