A new suit that asks a federal district court to overturn a Clean Water Act (CWA) waterbody cleanup plan that EPA issued in 2010 could pose a fresh test of the deference courts give regulators on scientific issues in permits, but one attorney says the suit could be influenced by the fact the plan is six years old. The city of Bolivar, MO, filed a complaint against EPA Oct. 28 in the U.S. District Court for the Western District of Missouri saying EPA erred when it crafted the federal total maximum daily load (TMDL) cleanup plan for the nearby Piper Creek that sets limits on nutrient discharges from its wastewater treatment plant.
