The district court hearing combined suits from the Navajo Nation and New Mexico over the 2015 Gold King Mine wastewater spill is weighing arguments from the tribal government and one of the mining company defendants over whether portions of the suit should be dismissed - the latest step in piecemeal litigation over who can be held liable for the disaster. The new briefs filed in the consolidated case known as New Mexico, et al. v. EPA, et al. deal with which court should hear the suit, and whether the contracting firm Environmental Restoration (ER), which worked on the cleanup attempt that triggered the spill, can be held liable for the result of a government-led project.(Doc.
