The federal district judge presiding over litigation on the 2015 Gold King Mine wastewater spill has again rejected EPA's bid for a quick resolution to at least some of the pending claims in the case, ordering the agency to delay seeking summary judgment until the years-long fact-finding process of discovery advances. In an Oct. 17 order, Chief Judge William P. Johnson of the U.S. District Court for the District of New Mexico writes that EPA acted prematurely in filing a motion just eight days after the start of fact-finding for the court to reject tort claims filed by the states of Utah and New Mexico, the Navajo Nation and private citizens over the spill.
