Trustees’ liability to third parties: Jersey v England

Jersey trust law and English trust law undoubtedly have much in common; but it would be wrong to think that the statute that constitutes the principal foundation for Jersey’s law of trusts, the Trusts (Jersey) Law 1984 (supplemented of course by case law) is in all respects reflective of English law principles—there are some important differences, some of which are fundamental. One of the most notable is the limited recourse of creditors to trust property, originally contained in Article 28 of the Law and now to be found, in amended form, in Article 32.
