摘要

Former NFL footballer Jim Brown has sued Sony Computer Entertainment and Electronic Arts (EA) for trademark infringement, alleging that the companies published a computer game featuring him as a character. The latest "Madden" game, produced by Sony and EA, features a player wearing a No. 32 jersey in the All Browns Team which Brown says is based on him. Brown wore a No. 32 jersey when he played for the Cleveland Browns team in an NFL career that stretched from 1957 to 1965. He was later inducted into the NFL Hall of Fame. In a quest for realism most of EA and Sony's sports based games feature real life athletes. Players typically sign agreements allowing the use of their names and likenesses. Brown, however, insists that no such deal was made between him and either party. In his suit Brown alleges that the "Madden" game has "unjustly enriched and have received and continue to hold ill-gotten gains," diluting his trademark rights for his likeness and reducing its value.
