ELI held 10 webinars. Here are a few of the highlights: BP Oil Spill: The ELI Ocean Program looked at the third phase of the BP oil spill trial. While the first two phases focused on which parties were at fault for the spill and how much oil was released into the Gulf of Mexico, the penalty phase is focused on the eight factors set out in the Clean Water Act that the court must take into account in determining civil liability under the statute. This has important implications for the 80 percent of CWA penalties that will be channeled through the RESTORE Act for economic and ecological recovery activities in the gulf.
