Advice Note Safety, Health and Welfare at Work (Construction) Regulations 2006: Designer's certificates

A designer must provide information to others as necessary to comply with his own duties under the regulations. Provision of certificates, if 'considered appropriate', are suggested in the Health & Safety Authority (HSA) Guidelines and model forms are provided in Appendix 2 of the Guidelines, although it is pointed out that the forms are not mandatory. There is no regulation which makes it mandatory for a designer to provide particular, or any, certification as such. A certificate may be requested by a particular party, such as the PSDP, but it may possibly be relied upon at face value by another person.
