The FCC has decided that incumbent local exchange carriers are entitled to the same relief from unbundling obligations for broadband facilities to apartment buildings and other multiple-dwelling units (MDUs) as they are for broadband facilities to single-family homes. The regulatory relief will apply only to fiber-to-the-home (FTTH) loops to buildings that are used predominantly for residential purposes. For example, an apartment building with retail space on the street level would fall under the unbundling relief provision in the reconsideration order adopted at the Aug. 4 meeting in Common Carriers dockets 01-338, 96-98, and 98-147, but an office building with a floor of residential suites would not.
