FCC Calls on High Court To Nix ISP-Bound Traffic Case

The FCC has filed its opposition to two related writs of certiorari filed with the Supreme Court that seek to overturn a January 2010 D.C. Circuit ruling which affirmed the Commission has the authority to determine that Internet service provider-bound traffic should be afforded different treatment than other section 251(b)(5) traffic under the 1996 Telecommunications Act.rnResponding to arguments filed in Core Communications, Inc., v. FCC (case no. 10-185) and Pennsylvania Public Utility Commission v. FCC (case no. 10-189), the agency noted that the federal appeals court had found that section 201 of the Act prohibits interstate carriers from charging rates that are not "just and reasonable" and allows the Commission to prescribe regulations to stop that from happening, which is what the agency did.
