NARUC Adopts Resolutions on ETFs, Internet Regulation, Wireless Billing

The National Association of Regulatory Utility Commissioners adopted several resolutions during its summer meetings in Sacramento including a resolution to preserve state regulatory rights in the event that the FCC decides to regulate broadband services as a telecommunications service.rnThe NARUC Board of Directions approved a resolution drafted in response to the FCC's June Notice of Inquiry on the regulatory treatment of Internet connectivity service. The NARUC resolution states that the proposed "third way" would give the FCC the ability to preempt any state requirement on Internet connectivity that the federal agency deemed to be contrary to its own decision not to apply such a requirement. Therefore, the resolution states that if the FCC were to implement the "third way" option that it "should be very clear that the rationale does not prejudice in any way state's authority reserved under section 253 of the Communications Act of 1934," particularly in the areas of universal service, public safety, service quality, and consumer rights.
