Rate Benchmark Takes Center Stage in Debate Over Appeal of FCC's High-Cost Order

The FCC did not go far enough in addressing the rate benchmark issue when it issued an order in April 2010 addressing a 2005 federal appeals court remand of its high-cost service rules for nonrural carriers, an attorney representing the Vermont Public Service Board told the U.S. Court of Appeals for the District of Columbia. During the Sept. 16 oral arguments in Vermont Public Service Board, et al v. FCC (case 10-1184), attorney Jim Lister explained to a three-judge D.C. Circuit panel that average basic phone rate in rural Vermont is $31, more than 50% higher than the $19 national urban rate, and that the agency needs to reset its benchmark standard to address such pricing disparities under the 1996 Telecommunications Act.
