WLF Sides With Facebook On Texas CDA Issues

The Washington Legal Foundation (WLF) has filed an amicus curiae brief asking the Texas Supreme Court to grant a writ of mandamus petition by Facebook, Inc., that would bar state civil claims pursuant to the Communications Decency Act (CDA) filed by three Jane Doe plaintiffs who allege they were lured into sex trafficking through communications on Facebook or Instagram. Federal law "squarely bars" the type of state civil claims regarding third-party content the plaintiffs are raising against Facebook, WLF said in its brief in In Re Facebook, Inc., and Facebook, Inc., d/b/a Instagram, case 20-0434).
