FCC Chairman Ajit Pai's transparency reform of releasing draft items three weeks ahead of the meetings at which he plans to seek a vote on them raised questions for a federal appeals court judge during a May 15 oral argument in challenges to the FCC's 2017 business data services (BDS) order. The BDS order, adopted by the FCC on a 2-1 party-line vote last year, eliminated ex ante price regulation of packet-based BDS and transport services, as well as legacy time division multiplex (TDM) services in counties that are "deemed competitive," after a transition period.
