FCC SEEN AS USING SPECTRUM POLICY FOR SOCIAL ENGINEERING

The FCC is determined to use spectrum to achieve broader social goals, attorney Ari Fitzgerald told Law Seminar International's spectrum conference. "Aggressive willingness" by the FCC to use spectrum to serve the public is seen widely in public safety, Fitzgerald said. He cited recent spectrum management proceedings, such as a proposed 700 MHz D-block order that would mandate public-private partnership to deploy and operate a broadband public safety network. Encouragement of open source platforms is another area under review, he said, citing 700 MHz C-block open access requirements. The FCC also is considering efforts to boost rural broadband adoption by attaching a "free broadband" condition to the AWS-3 band, said Fitzgerald. Interference management is the challenge, Fitzgerald said. Spectrum scarcity, especially below 3 GHz, and emergence of new wireless business plans seeking to take advantage of more "spectrally efficient" technologies, demand FCC interference management be "more sophisticated," he said.
