MEETING WILL DECIDE HOW VERMONT HANDLES LICENSE THREAT TO FAIRPOINT

A Sept. 30 conference between FairPoint Communications and the Vermont Public Service Board will determine how the regulator handles a demand that the carrier justify being allowed to continue to do business in Vermont, a board official said. The board Monday gave FairPoint until Sept. 9 to file a response to a show-cause petition by the Department of Public Service. State law allows the board to pull a carrier's certificate of operation "for good cause," said Susan Hudson, the board's clerk. "The reasons can include not performing according to conditions imposed on a company by the board, but the circumstances that can lead to decertification are not necessarily express." Smaller companies have lost Vermont certification, Hudson said. In some such cases the issue was inadequate service, the basis of the department's complaint against FairPoint. "The board doesn't get a lot of petitions in this area," Hudson said.
