The FCC Media Bureau granted Time Warner Cable's petition for a determination that it'snsubject to effective competition in five Kentucky communities. TWC submitted sufficient evidencendemonstrating "that both prongs of the competing provider test are satisfied and petitioner is subjectnto effective competition in the communities," the bureau said in a memorandum opinion and ordern(http://bit.ly/109ZcqM). The bureau found that TWC also provided sufficient evidence supportingnits assertion that potential customers are reasonably aware that they may purchase the service ofnDirecTV and Dish Network. The bureau also found that TWC demonstrated the percentage ofnhouseholds subscribing to its cable service is less than 30 percent of the households in the countiesnof Caldwell, Hopkins and Webster, it said.
