ORR prosecutes Network Rail over Grayrigg crash Pendolino derailment

On January 13, the Office of Rail Regulation (ORR) started criminal proceedings against Network Rail for a breach of health and safety law which caused Virgin Pendolino 390033 to derail near Grayrigg on February 23 2007 killing one passenger. The 1715 Euston-Glasgow Central derailed on the West Coast Main Line near Grayrigg in Cumbria. 109 people were on board and Mrs Margaret Masson, 84, was killed. 86 people were injured, 28 seriously. Network Rail is facing a charge under the Health and Safety at Work Act 1974. This results from the company's failure to provide and implement suitable and sufficient standards, procedures, guidance, training, tools and resources for the inspection and maintenance of fixed stretcher-bar points.
