Evergreen 3 (RBI358 p1) is now being funded through NR's Regulatory Asset Base, with Chiltern covering the return through an additional facility charge to NR. In agreeing funding through the RAB, ORR has also approved the inclusion of the first-ever rebate mechanism in a track access contract.rnThis rebate is intended to prevent another operator from using a 'free ride' on the new infrastructure to undermine Chiltern's ability to repay the cost of the investment. For example, an open-access operator would, potentially, have lower access charges and thus be able to charge lower fares.
