Judge rules Nebraska Public Power District cannot exit PPAs for four wind farms

The Nebraska Public Power District cannot exit power purchase agreements with four wind farms in the state, a federal appeals court ruled. NPPD wanted to terminate agreements with the farms, which are owned by New York-based asset manager Global Infrastructure Management Participation LLC. The public utility argued that it could leave the contracts because ownership of the wind farms changed hands. Laredo Ridge Wind, Broken Bow Wind and Crofton Bluffs Wind sued the public power district in January 2019, alleging it unlawfully attempted to exit the PPAs early. The groups, which are portfolio companies of Global Infrastructure Management, own the 79.9-MW Laredo Ridge Wind Farm in Boone County, the 79.9-MW Broken Bow Wind Farm in Custer County, and the 40-MW Crofton Bluffs Wind Farm (Crofton Hills) in Knox County, respectively.
