FERC drops mandatory refund requirement for non-public utilities in MISO , SPP

The Federal Energy Regulatory Commission Thursday reversed a 2017 decision that imposed broad new refund commitments on non-public utility transmission owners in Midcontinent Independent System Operator and Southwest Power Pool. FERC’s refund authority under the Federal Power Act applies only to public utilities. While it may review the rates of non-public utility transmission owners, such as state- or municipally-owned utilities and cooperative utilities, when they join regional transmission organizations, it cannot directly order refunds from them.
