Appeals court rejects Maryland utility's bid to recover $38 million in tax costs

Baltimore Gas and Electric may not saddle ratepayers with millions ofdollars of tax-related expenses that the Maryland utility failed tocapture in past years, the DC Circuit Court of Appeals said in a rulingupholding the Federal Energy Regulatory Commission’s rejection of theutility’s rate proposal.A December 2016 rate filing (ER17-528) from BGE proposed amechanism to refund or recover, as needed, certain deferred incometax excesses and deficiencies previously recorded and on an ongoingbasis. The proposal would have allowed BGE to recover from futureratepayers around $38 million in tax-related costs dating back to 2005for which consumers had not been charged.
